Scammed On Ebay

It is a legally binding contract - but as is the agreement with whoever else he sold the couch to. Given he probably sold the couch to them first then he had basically nothing to sell to you...

 

Your best course of action is to complain to eBay and the guy will get a warning, but basically your not going to get anything...

He's offered an alternative so i doubt there's much you can do.

I'd leave negative feedback and move on. Ebay say it is a binding contract but I cannae see how they'd enforce it.

 

What was his selling history like?

So an old guy uses ebay for the first time, makes a mistake and you're going bananas. Sounds like he's made a genuine error; these things happen. I'm sure there will be plenty more sofas similar coming up.

 

You haven't lost out on any money, and nobody died, so just leave it at that. Its not like you've been scammed.
